2. Prices and Payment
- Prices: The product prices will be those displayed on the website at the time of placing the order. All prices include the legally applicable **Value Added Tax (VAT)**.
- Shipping Costs: Shipping costs will be calculated during the checkout process based on the destination.
- Payment Methods: We accept the following payment methods: **Credit/debit card** and **Bank Transfer**.
3. Shipping and Delivery Times
- Shipping Area: We ship to the **Iberian Peninsula, the Balearic Islands, Portugal, France, Italy, and Germany**.
- Delivery Time:
- Iberian Peninsula and Balearic Islands: The estimated delivery time is **48 to 72 working hours** from payment confirmation.
- Rest of Countries (Portugal, France, Italy, Germany): The estimated delivery time is up to **5 working days**, depending on the transport conditions.
- Delivery Incidents: If the order cannot be delivered due to reasons attributable to the customer (incorrect address, repeated absence, etc.), re-shipping costs will be borne by the customer.
- Package Receipt (Mandatory Check): It is crucial that the customer **checks the condition of the packaging** at the time of delivery. Should you detect any impact, breakage, opening, or signs of tampering, this must be **noted on the carrier's delivery note** and the incident must be reported to info@elmariscaldeljamon.com within a maximum of **24 hours**.
4. Right of Withdrawal and Exceptions (Returns)
Exclusion of the Right of Withdrawal (Food Products): In accordance with Article 103 of the General Law for the Defense of Consumers and Users (LGDCU), products that are liable to deteriorate or expire rapidly, as well as sealed goods that have been unsealed after delivery for reasons of health or hygiene, **are excluded from the right of withdrawal**. Therefore, returns due to a change of mind are not accepted once the packaging or seal has been opened.
- Conditions for Returns Due to Defect, Damage, or Error: Returns will only be accepted if the product is **defective, damaged, unfit for consumption, or has been sent in error.**
- Essential Requirement (Labeling and Traceability): To process any return, the product must be returned with its **original and complete labeling** (including expiration/best-before date, batch number, and seals or markings, if applicable). **The absence of this labeling will invalidate the return process** as it prevents correct product identification and traceability.
- The customer must report the incident within a maximum of **48 hours** of receipt to info@elmariscaldeljamon.com, attaching clear photographs of the defect and the labeling.
- Upon verification, FRANQUICIAS VICMAR S.L. will arrange the collection and proceed with its replacement or refund.
5. Specific Return Policy for Hams and Shoulders (Cutting)
- Quality Guarantee: If the customer detects a serious and objective defect in the ham or shoulder after starting to slice it (abnormal taste, bad smell, product in poor condition, etc.):
- They must **immediately stop cutting** and photograph the affected area.
- Weigh and store the remaining product.
- Report it immediately to info@elmariscaldeljamon.com.
- Traceability Requirement for the Return of Whole Pieces: To proceed with the assessment and, where appropriate, the refund or replacement, it is **mandatory** that the customer retains and returns the ham or shoulder piece with **all identifying references for origin, packaging, and traceability** (including labels, bands, stamps, seals, and covers, if applicable).
- Procedure: FRANQUICIAS VICMAR S.L. will arrange the collection. If the defect is confirmed by our Master Ham Cutter, a replacement piece of the same quality will be offered, or a proportional refund for the unconsumed portion will be issued.
6. Refunds
- The refund will be processed using the same payment method used by the customer for the initial transaction, unless expressly agreed otherwise and provided the refund does not incur any additional costs.
- The maximum period for making the refund is **14 calendar days** from the date the return was communicated and accepted.
